If you are arrested by a State Patrol Trooper or a Snohomish County Sheriff's officer, in the east part of Snohomish County, your case is likely to be filed in Evergreen District Court in Monroe. This is one of 4 divisions of the Snohomish County District. Court. The court is presided over by Judge Clough and Judge Lyon. Both Judges are highly experienced in these matters.
If you are arrested for a Monroe DUI, you may be processed and released or could be booked into the Snohomish County jail. Often this will depend on any priors offenses you may have, your level of breath test, or level of cooperation. And other circumstances of your case.
If you are booked bail will be set at a scheduled amount, until you see a judge, who could raise bail, or release you on your own recognizance, though usually with conditions imposed on your driving and consumption of alcohol. You must follow these conditions or risk return to custody.
If you are release, it will generally be 2-4 weeks before charges are filed after being reviewed by prosecutors. These cases are prosecuted by the Snohomish County Prosecutors office. You will be summonsed for a first appearance. At this time the court will review and impose conditions upon your release. These will involve standard conditions of no driving without valid license and insurance,, no consumption of alcohol, no refusal of a breath test. If your breath test was extremely high or if you have had a prior offense, you can expect the court may impose more restrictive conditions, such as instillation of ignition interlock.
